The legal framework regulating assisted human reproduction is fundamentally constituted by Law 14/2006, of 26 May, on assisted human reproduction techniques.
- Sperm donation is a free, formal and confidential contract entered into between the donor and the authorised institute. Both the sperm bank and the records of donors and activity of the institutes must guarantee the confidentiality of donors' identity data.
- Donation can only be revoked if the donor needs the donated gametes for himself, provided they are available on the date of revocation. Upon revocation, the donor shall return the expenses of any type caused to the receiving institute.
- The maximum authorised number of children born in Spain generated with sperm from the same donor may never exceed six. For the purpose of maintaining the effectiveness of this limit, with each donation, donors must declare whether they have made other prior donations, as well as the conditions of these, and indicate the date and the institute where these donations were made.
- In any event, authorised institutes may reject a donation if the donor's psychophysical condition is not suitable. In the event a donor is not accepted as such, he will have right to know the reasons that motivated his exclusion, guaranteeing
